This privacy policy governs how Ecoclim Inc (hereinafter referred to as "Ecoclim") collects, uses, retains, and discloses Personal Information collected from you and other Users ("you" or "User") when using this website (the "Site"), whether accessed via the Internet, a mobile device, or other electronic devices, or by any other means. The Site is owned by Ecoclim.
This privacy policy applies to the Site and all products and services we offer on the Site. We are committed to protecting the personally identifiable information (as defined below) we collect.
1. DEFINITIONS
- Collection: The act of gathering, using, acquiring, or obtaining Personal Information in any way and by any means, including from Third Parties.
- Consent: Free agreement to the Collection and/or disclosure of Personal Information for specified purposes. Consent may be explicit or implicit, as provided by law, and may be given directly by the User or by an authorized representative. It must be unequivocal.
- Disclosure: The act of revealing Personal Information to a Third Party.
- Personal Information: Any information about an individual that allows for identification, directly or indirectly.
- Personal Information Protection Officer: The person at Ecoclim responsible for ensuring compliance with and the application of this policy in accordance with section 3.1 of the Act to modernize legislative provisions regarding the protection of personal information.
- Third Party: Any person other than a User, Ecoclim, or an agent of Ecoclim.
- User: Any customer or person accessing any customer service offered by Ecoclim or the Site.
- Use: The processing, manipulation, and management of Personal Information by Ecoclim.
2. RESPONSIBILITY
We will inform you at the time of Collection and upon request afterward about:
- The purposes for which Personal Information is collected;
- The means by which it is collected;
- The rights of access and rectification provided by law;
- Your right to withdraw your Consent;
- The name of any Third Party for whom the Collection is made, the name of any Third Parties, or categories of Third Parties to whom it is necessary to communicate the Personal Information for the purposes for which it was collected;
- The possibility that this Personal Information may be communicated outside Quebec.
Any User providing their Personal Information consents to its use and communication for the purposes mentioned above. We are responsible for the Personal Information we hold or have custody of, including Personal Information entrusted to a Third Party for processing purposes.
We have designated a Personal Information Protection Officer who ensures compliance with and the application of the principles outlined in this policy and the Act to modernize legislative provisions regarding the protection of personal information. Other persons may also be designated to perform these functions.
We will obtain the Consent of the holder of parental authority or the guardian when collecting Personal Information from a child under 14 years of age.
We have developed various guidelines and practices to implement this policy, including:
- Implementing policies and practices governing our governance regarding Personal Information.
- Implementing procedures for receiving and handling information requests or complaints.
- Establishing a privacy incident register.
- Establishing a Personal Information retention schedule.
- Providing information and training to employees on personal information protection (effective May 30, 2024).
3. WHAT PERSONAL INFORMATION DO WE COLLECT?
We may collect two types of information from Users of our Site:

We adopt appropriate practices for the Collection, storage, and processing of data, as well as security measures to protect your Personal Information against unauthorized access, alteration, disclosure, or destruction.
Sensitive data exchanges between the Site and its Users occur via a secure, encrypted communication channel protected by digital signatures.
We do not guarantee that Personal Information, searches, or other communications will always remain secure. Users acknowledge that they provide this Personal Information at their own risk.
9. THIRD-PARTY WEBSITES
We do not control the content or links of Third-Party sites displayed on our Site. Browsing on other sites is subject to the policies of those sites. We are not responsible for the personal information protection practices of websites not owned by Ecoclim.
10. ACCURACY AND ACCESS TO PERSONAL INFORMATION
We ensure that Personal Information is up to date and accurate. You can obtain a copy of your Personal Information by contacting the Personal Information Protection Officer in writing. We will respond to access or modification requests diligently and within a reasonable time not exceeding 30 days.
11. RETENTION OF YOUR PERSONAL INFORMATION
Your Personal Information is stored on a server located in Canada. It may be communicated and stored outside Quebec by our partners, but in compliance with the conditions of the Act on the protection of personal information in the private sector. Personal Information is destroyed or anonymized once the purposes have been achieved.
12. YOUR ACCEPTANCE OF THIS POLICY AND ITS AMENDMENTS
By using this Site, you accept this policy. Continuing to use this Site after modifications to this policy implies acceptance of these modifications.
13. WITHDRAWAL OF YOUR CONSENT
You can withdraw your Consent by contacting the Personal Information Protection Officer. Withdrawing Consent may make certain services unavailable.
14. SUBSIDIARIES AND ENTITIES
You consent to Ecoclim, its subsidiaries, and related entities communicating Personal Information among themselves in accordance with this privacy policy.
15. COMPLAINT
Anyone can file a complaint by contacting the Personal Information Protection Officer. Ecoclim has established a process for handling complaints related to the treatment of Personal Information.
16. INTELLECTUAL PROPERTY, COPYRIGHTS, AND TRADEMARKS
All content on this Site is the exclusive property of Ecoclim, its subsidiaries, its related entities, or Third Parties who have granted it licenses and cannot be used without written permission. Downloading and printing content for personal and non-commercial use is permitted. Trademarks are the exclusive property of Ecoclim or Third Parties who have granted it licenses and cannot be used without written permission.
17. OFFICIAL VERSION
The French version of this policy is the official version and prevails over the English version.
18. APPLICABLE LAWS
This privacy policy is governed by the provincial and federal laws applicable in the User's province of residence.
